Divide Independent School District ("the District") has adopted policies and procedures required by Senate Bill 12 (89th Texas Legislature) and Texas Education Code §§11.005(c) and 28.0022(h). In accordance with Texas Education Code §39.008, the District is providing this notice to all contractors, vendors, and third parties that provide goods or services to the District.
By entering into or continuing a contractual or service relationship with the District, contractors and vendors are notified of, and are expected to comply with, the following requirements when acting on behalf of or providing services to the District:
Diversity, Equity, and Inclusion (DEI) Requirements — Contractors and vendors may not, in connection with services provided to the District: establish, maintain, or perform the duties of a DEI office or position on behalf of the District; require, provide, or conduct DEI training for District employees or students as a condition of any District program or service; give preferential treatment to, or discriminate against, any person on the basis of race, color, ethnicity, gender identity, or sexual orientation in the provision of services to the District; or adopt or promote policies or practices inconsistent with the District's obligations under Senate Bill 12 and Texas Education Code §11.005.
Parental Rights and Instructional Requirements — Contractors and vendors providing instructional materials, programming, or services to students must comply with the District's policies adopted under Texas Education Code §28.0022, including requirements regarding parental rights and limitations on instruction concerning sexual orientation and gender identity.
Contractor Acknowledgment — Contractors and vendors are responsible for ensuring that their employees, subcontractors, and agents who provide services to the District are aware of and comply with these requirements. Failure to comply may result in termination of the contractual or service relationship with the District.
